These Terms and Conditions (“Terms”) govern your access to and use of the website located at domu.ai (the “Site”) and the AI-powered voice agent platform and related services (collectively, the “Services”) provided by Domu Technology Inc., a Delaware corporation (“Domu,” “we,” “us,” or “our”). By accessing the Site or using the Services, you (“Client” or “you”) agree to be bound by these Terms. If you do not agree, do not use the Site or Services.
1. About Domu
Domu Technology Inc. is a software-as-a-service (“SaaS”) company. Domu provides an AI-powered voice agent platform that enables enterprises to automate phone-based consumer communications.
Domu does not act as a debt collector, Domu is solely a technology provider.
2. Services
Domu’s platform enables clients to deploy AI voice agents for consumer communications. Services include:
AI-driven outbound and inbound voice conversations
Configurable agent scripts and call workflows
Real-time analytics and call monitoring dashboards
API and webhook integrations with third-party systems
Compliance tooling for call logging and reporting Services are provided under the tier and scope defined in the applicable Order Form or Master Services Agreement (“MSA”). Beta or preview features are provided “as-is” and may be modified or discontinued at any time.
3. Account Access
You agree to provide accurate registration information and maintain its accuracy. You are responsible for the security of your account credentials and for all activity under your account.
Enterprise clients may grant access to authorized employees or contractors and are responsible for those users’ compliance with these Terms. Credentials may not be shared or transferred to unauthorized parties.
4. Acceptable Use
You agree to use the Services lawfully and only for their intended purpose. You may not:
Use the Services in violation of any applicable federal, state, or local law or regulation;
Use the Services to harass, threaten, or deceive any individual;
Attempt to access, reverse engineer, or extract any underlying software, models, or architecture of the platform;
Introduce malicious code or attempt to disrupt platform operations;
Use the Services in any way that infringes a third party’s rights.
Clients bear sole and exclusive responsibility for ensuring their use of the platform complies with all laws applicable to their business and their consumer communications, including consent requirements, calling rules, required disclosures, and applicable sector-specific regulations. Domu does not provide legal, compliance, or regulatory advice.
5. Regulatory Compliance
5.1 TCPA. The Telephone Consumer Protection Act imposes strict requirements on automated voice communications. Client is solely responsible for obtaining and maintaining all required consumer consents before initiating any AI-driven calls through the platform.
5.2 Client Regulatory Obligations. Client is responsible for complying with all regulations applicable to its industry and use case, including any applicable consumer protection, financial services, or communications laws. Domu’s role is limited to providing the technology platform.
5.3 PCI DSS. Domu’s platform is designed to operate outside the cardholder data environment (“CDE”). The platform does not capture, transmit, store, or process payment card data during AI-driven conversations. Domu operates as a service provider outside of PCI DSS CDE scope. Clients remain solely responsible for their own PCI DSS compliance.
6. Data and Privacy
Where Domu processes personal data on behalf of enterprise clients, such processing is governed by a Data Processing Agreement (“DPA”) executed as part of the applicable MSA. Clients are responsible for ensuring they have all necessary rights and consents to submit data to the platform.
Domu maintains reasonable technical, administrative, and physical safeguards to protect data processed through the platform. For California residents, Domu acts as a “Service Provider” under CCPA/CPRA and does not sell or share personal information processed on behalf of clients.

7. Intellectual Property
All right, title, and interest in and to the platform — including all software, AI models, algorithms, interfaces, documentation, and trademarks — belong exclusively to Domu Technology Inc. These Terms do not transfer any ownership rights to Client.
Subject to these Terms, Domu grants Client a limited, non-exclusive, non-transferable license to access and use the platform solely for Client’s internal business purposes during the subscription term. Client retains ownership of all data it submits to the platform. Domu will not use Client data or call recordings to train foundational AI models without Client’s prior written consent.
8. Modifications
Domu may update these Terms at any time by posting the revised version to this page with an updated effective date. Continued use of the Site or Services after any change constitutes acceptance of the revised Terms.
9. Termination
These Terms are effective while Client accesses the Site or uses the Services. Subscription terms are governed by the applicable MSA or Order Form. Domu may suspend or terminate access if Client materially breaches these Terms or violates applicable law. Sections 4, 5, 6, 7, and 10 survive termination.
10. SMS/Text Messaging Program Disclosures
As part of its services, Domu Technology Inc. operates an automated text messaging (SMS/MMS) program on behalf of its enterprise clients to deliver AI-powered communications to end consumers.
The following disclosures apply to all SMS/MMS messaging conducted through Domu’s platform in accordance with the Telephone Consumer Protection Act (TCPA) and the guidelines of the Cellular Telecommunications Industry Association (CTIA).
Program Name: Domu Technology Messaging Program Program Description: Domu’s text messaging program facilitates automated SMS/MMS communications on behalf of financial services clients, including payment reminders, account notifications, collection notices, appointment confirmations, and other client-authorized service-related messages to consumers in the United States.
Message and Data Rates: Message and data rates may apply. Charges are assessed by your mobile carrier and are not controlled by Domu Technology Inc. Please contact your wireless service provider for details on your messaging plan and applicable charges.
Message Frequency: Message frequency varies based on your account activity and the nature of services provided by our enterprise clients. You may receive multiple messages per month depending on your account status and applicable program enrollment. Recurring messages may be sent as needed to fulfill contracted services.

Opt-Out Instructions: To stop receiving messages from this program at any time, reply STOP to any message you receive. After sending STOP, you will receive a final confirmation message and will no longer receive messages from that program. To re-enroll, follow the enrollment instructions provided by our client or contact domu@domu.ai.
For additional assistance after opting out, reply HELP or contact us at the details above. Opting out of text messages does not affect your rights or obligations under this Privacy Policy or under applicable law.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” DOMU DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. DOMU DOES NOT WARRANT THAT USE OF THE SERVICES WILL RESULT IN COMPLIANCE WITH ANY LAW OR REGULATION.
AI-GENERATED OUTPUTS MAY CONTAIN ERRORS; CLIENT IS RESPONSIBLE FOR REVIEWING ALL CONFIGURATIONS BEFORE LIVE DEPLOYMENT.
12. General
These Terms are governed by the laws of the State of Delaware. These Terms, together with any executed MSA, Order Form, DPA, and Privacy Policy, constitute the entire agreement between the parties on this subject matter. If any provision is held invalid, the remainder continues in effect.
Client may not assign these Terms without Domu’s written consent. Domu may assign in connection with a corporate transaction. Neither party is liable for delays caused by events outside its reasonable control.
